TERMS OF USE
The terms that apply when you use the Bawley Vale Estate website and the services offered through it.
Who we are
Bawley Vale Estate Pty Ltd ("we", "us", "Bawley Vale Estate") operates the venue at 226 Bawley Point Road, Bawley Point NSW 2539 and the website at bawleyvale.estate, including event listings, ticket sales, enquiry forms, and guest and vendor portals (together, the "site").
By using the site you agree to these terms. If you don't agree with them, please don't use the site.
Fair use of the site
The site exists so you can find out about the estate, enquire about weddings and events, buy tickets, and — if you're a guest, vendor, or couple we're working with — use your portal. Use it for those purposes. In particular, you agree not to:
- access or attempt to access accounts, portals, or systems you haven't been given access to, or probe, scan, or test the site's security other than through a responsible disclosure to us first;
- scrape, harvest, or bulk-download content or personal information from the site, or use automated tools to submit forms, hold tickets, or hammer our infrastructure;
- submit false, misleading, or deliberately wasteful enquiries or bookings (including holding dates or tickets you have no intention of using);
- upload or submit anything unlawful, defamatory, infringing, or malicious (including malware) through any form, upload, or portal;
- resell tickets at a premium, or misrepresent an event, its pricing, or your association with the estate;
- use the site in a way that interferes with anyone else's use of it.
We may suspend or block access, cancel bookings or tickets, and remove content where these terms are breached. Where the breach involves payment fraud, safety, or unlawful activity we may also involve the relevant authorities.
Accounts and portals
Some parts of the site (guest, couple, and vendor portals; ticket QR codes) are accessed by invitation, magic link, or credentials. Keep your access details and links private — anything done through your access is treated as done by you, so tell us promptly at the contact below if you think your access has been compromised. We may suspend portal access while we investigate suspected misuse.
Enquiries, bookings, and tickets
- Information you submit in enquiries and bookings must be accurate; we rely on it to plan real events.
- Weddings and private events are governed by the signed contract for that event. If these terms and your contract conflict, the contract wins.
- Accommodation stays are governed by the booking terms presented at the time of booking.
- Tickets to public events are for the named event only. Entry uses a QR code that is unique to your ticket — share it and whoever uses it first gets in. Tickets aren't transferable for profit. Refunds and cancellations follow the policy stated at purchase and our obligations under the Australian Consumer Law; where we cancel an event, you'll be offered a refund.
- Event details (dates, line-ups, inclusions) can change for reasons including weather and safety; we'll publish changes on the event page and notify ticket-holders where we can.
Your content
Where the site lets you submit content (enquiry details, reviews, messages, photos), you confirm you're entitled to submit it and you give us a non-exclusive licence to use it to operate the estate and the site (for example, showing your review, or sharing your planning details with your coordinator). We don't use your content for marketing without asking. Don't submit other people's personal information without their permission.
Our content
The site's content — text, photography, design, event imagery, and branding — belongs to us or our licensors (including photographers credited for estate imagery). You're welcome to share links to the site (that's what the share buttons are for); don't republish or commercially reuse content without our written permission. Couples' private galleries are exactly that — private — and stay subject to the photographer's own licence terms.
Accuracy and availability
We keep the site as accurate and available as we reasonably can, but it's a working venue's website, not a guarantee: availability calendars, pricing, and event details can change between your visit and our confirmation, and the site may occasionally be down for maintenance. Nothing on the site is an offer that binds us until we confirm it.
Liability
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Subject to that, and to the maximum extent the law allows: we exclude liability for indirect and consequential loss arising from use of the site; and our total liability in connection with the site is limited, at our option, to resupplying the relevant service or refunding what you paid for it. Your use of information on the site is at your own judgement — for anything that matters, confirm with us directly.
Privacy
Our privacy policy explains what personal information we collect through the site and what we do with it, including under the Australian Privacy Act, UK and EU GDPR, and the CCPA/CPRA.
Changes to these terms
We may update these terms from time to time; the Last updated date at the top reflects the current version. Material changes will be flagged on this page. Continued use of the site after a change means you accept the updated terms.
Governing law and contact
These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts. Questions about these terms: [email protected] or 226 Bawley Point Road, Bawley Point NSW 2539.
